Governmental Services: Dissolution of a Public Authority

Michael J. Cahill, representing the County of Montgomery, negotiated the terms of a series of transactions, including the preparation and adoption of state legislation, to dissolve the Montgomery Otsego Schoharie Solid Waste Management Authority (MOSA). Upon dissolution, the assets and liabilities of the authority are to be distributed among its member counties. MOSA had served its member counties in providing solid waste disposal services for over twenty-five years. Dissolution required the counties to take title to three closed landfills, five transfer stations and an administration building, distribution of approximately $2-$3 million in cash reserves and operating funds, organization of local services to fill the roles formerly performed by MOSA, and provision for long term management of the authority’s closed landfill facilities. MOSA will cease services on May 1, 2014, and be dissolved no later than October 1, 2014.

Michael Cahill, representing the municipality in defense of local solid waste “flow control” legislation, appeared and argued before the United States Court of Appeals in plaintiff/appellant’s appeal from a grant of partial summary judgment upholding the law. The plaintiff/appellant appealed from a judgment dismissing claims that the Oswego County local law was unconstitutionally vague, effected an unconstitutional taking, deprived plaintiff of due process, and violated plaintiff’s equal protection rights. Mr. Cahill had represented the County in its summary judgment motions in the District Court for the Northern District of N.Y. The Court of Appeals concluded that the arguments of plaintiff/appellant were without merit and affirmed the judgment of the court below.

McAvoy granted, in part, the municipality’s motion thereby dismissing plaintiff’s (1) Taking Claim on the ground that the claim is not ripe because plaintiff did not exhaust available state remedies; (2) Due Process claim on the ground that plaintiff failed to identify any legally cognizable infringement on a protected property interest; (3) Equal Protection claim on the ground that plaintiff failed to demonstrate that it was treated differently than another similarly situated entity or person; and (4) vagueness challenges, save one provision authorizing a case-by-case determination of recyclables, which the municipality plans to repeal.

Doris Bilotti successfully represented and argued on behalf of Defendant/Appellant Wiblishauser in this appeal from the New York Supreme Court’s award of summary judgment to Plaintiff in an action pursuant to Article 15 of the Real Property Actions and Proceeds Law. In its decision interpreting Suffolk County’s real property redemption provisions, the Appellate Division unanimously reversed the order of the Supreme Court and found that there exist triable issues of fact in this matter between the parties, owners of adjoining residential property in Suffolk County.
